RankUp terms of use

These Terms govern access to RankUp's websites, applications, study tools, competition, AI coaching, AGSU tools, subscriptions, and related services.

1. Agreement to these Terms

These Terms of Use ("Terms") are a legal agreement between you and Arctic Aura Designs LLC, doing business as RankUp ("RankUp," "we," "us," or "our"). They govern your access to rankuparmy.com, app.rankupboard.com, RankUp mobile applications, APIs, study content, competitive modes, AI coaching, AGSU tools, subscriptions, support, and related services (collectively, the "Services").

By creating an account, clicking to accept, purchasing a subscription, or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services. If you use RankUp on behalf of an organization, you represent that you have authority to bind that organization; however, RankUp accounts are designed for individual preparation unless RankUp agrees otherwise in writing.

2. Eligibility

You must be at least 18 years old and legally capable of entering this agreement. The Services are not offered to children or minors, even with permission from a parent or legal guardian. The Services are intended for a United States launch and may not be available in every location. RankUp may refuse access where offering the Services would violate law, contract, or platform requirements.

3. RankUp is unofficial

RankUp is independent preparation and coaching software. It is not endorsed, sponsored, approved, or operated by the U.S. Army, Department of Defense, or any government agency. References to Army publications, programs, ranks, uniforms, boards, or public materials are descriptive. Government names and public-source materials remain the property of their respective owners. RankUp's abstract brand and original software are not official insignia or marks.

4. Your MOI and official sources control

Board topics, procedures, uniform requirements, source versions, and expected responses can vary by component, unit, location, and date. Your current memorandum of instruction, chain of command, sponsor, local board guidance, and applicable primary publications control. RankUp content is a preparation aid and must not be treated as an order, policy determination, official publication, certification, or substitute for local guidance.

5. No guaranteed outcome or professional advice

RankUp does not certify inspection readiness or guarantee promotion, selection, induction, appointment, award, score, rating, board result, or any other official outcome. The Services do not provide operational, emergency, medical, mental-health, legal, financial, personnel, or command advice. Use the appropriate official or emergency channel for those matters.

6. Accounts and account security

You must provide accurate required information, maintain a valid sign-in method, and keep account access secure. Use a pseudonymous handle and do not imply that you are RankUp staff, a moderator, or an official government representative. You are responsible for activity under your account unless caused by RankUp's breach of duty. Notify support promptly if you suspect unauthorized access. RankUp may require reauthentication or other reasonable verification before changing sensitive settings, exporting data, or deleting an account.

7. Limited license

Subject to these Terms, RankUp grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services for lawful, noncommercial board preparation. Any mobile-app license applies only on devices you own or control, subject to applicable app-store rules. RankUp and its licensors reserve all rights not expressly granted.

8. Acceptable use

You may use RankUp only for lawful, public, unclassified preparation. You must comply with these Terms, the Community Guidelines, applicable law, and reasonable product instructions. You may create personal study exports and checklists for your own preparation, but you may not present them as official, current, complete, or endorsed.

9. Prohibited conduct and information

You may not:

  • Submit classified information, controlled operational information, export-controlled technical data, medical records, legal case information, personnel records, Social Security numbers, DoD IDs, passwords, authentication tokens, payment-card data, or information you lack authority to use.
  • Harass, threaten, discriminate against, impersonate, stalk, exploit, or expose another person; post unlawful or abusive content; or evade a block, report, moderation action, or account restriction.
  • Cheat, collude, automate play, manipulate matches, ratings, leaderboards, usage allowances, referrals, or results, or misrepresent AI or practice results as official outcomes.
  • Probe, scan, scrape, reverse engineer, decompile, circumvent access controls, bypass rate limits, interfere with the Services, introduce malicious code, overload infrastructure, or use unauthorized bots or automated collection, except to the limited extent a restriction is prohibited by law.
  • Copy, sell, sublicense, publish, redistribute, create a competing question bank from, or commercially exploit RankUp content, reports, source annotations, designs, software, or datasets without written permission.
  • Use the Services or output to train, evaluate, benchmark, or improve a competing model, product, or dataset without written permission.
  • Violate intellectual-property, privacy, publicity, contractual, or other rights, or encourage another person to violate these Terms.

10. Study content and source versioning

RankUp editors author and review published study content using public, unclassified sources. Each published version may include a source title, identifier, location, effective date, and verification date. Corrections create new versions; retired versions may remain attached to historical results.

RankUp aims for accurate, source-grounded content but does not warrant that every question, explanation, citation, publication date, or link is complete, current, or error-free. Publications, policies, and local requirements change. Report suspected content issues through the question-detail flow and verify before relying on any answer.

11. AI features and output

AI mock boards, study coaching, transcription, and visual observations use automated systems and may produce inaccurate, incomplete, inconsistent, biased, or inappropriate output. AI feedback is practice feedback only. It is not an official board, inspection, evaluation, decision, or recommendation by the Army, Department of Defense, your command, or RankUp personnel.

RankUp may constrain AI output with authored rubrics, source bundles, deterministic rules, and safety filters, but those measures do not eliminate error. You must review cited sources and use independent judgment. Do not use AI features for emergency, operational, medical, legal, personnel, classified, or high-impact decisions.

12. Microphone, camera, and AGSU images

Voice mock boards require microphone permission and send audio to an AI provider for real-time interaction and transcription. Optional board-camera coaching analyzes continuous frames on-device and sends only limited derived observations for the report. Camera observations do not change knowledge accuracy.

AGSU photo checks require you to preview and affirmatively upload face-treated garment images. Re-encoding and automated cropping or blurring reduce privacy risk but may not remove every identifying or sensitive detail. Check the image and background before upload. Do not upload another person's image without authority and consent.

AGSU findings are confidence-aware preparation aids, not official inspections or certifications. Verify each finding against the cited current publication and appropriate official guidance.

13. Competitive and community features

Competition is intended to make recall practice engaging. Ratings, tiers, placements, achievements, streaks, and leaderboards are product metrics only and do not represent military rank, fitness, standing, qualification, promotion potential, or official performance. Bots are labeled where used. RankUp may investigate anomalous play, correct technical errors, void results, adjust ratings, remove leaderboard entries, or restrict features to protect fairness and safety.

14. Content you submit

You retain any rights you have in written responses, transcripts, support messages, reports, feedback, profile information, rack selections, images, and other material you submit ("User Content"). You represent that you have the rights and authority needed to submit User Content and that it complies with these Terms.

You grant RankUp a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, modify for technical purposes, display to you or intended recipients, and otherwise use User Content only as reasonably necessary to provide, secure, moderate, support, and improve the Services; comply with law; and enforce these Terms. This license ends when the content is deleted from active systems, except for lawful retention, de-identified information, backups pending rotation, and material needed to resolve disputes or protect the Services.

15. Content reports and moderation

You may report study content or another member through the available controls. RankUp may review relevant account, match, report, and technical information; remove content; restrict profile, friend, competitive, AI, or other access; or suspend or terminate accounts. RankUp is not obligated to monitor every activity and does not promise a particular outcome from a report. Knowingly false, abusive, or retaliatory reports violate these Terms.

16. Free features, trials, and promotions

RankUp may offer free features, limited AI trials, promotional codes, beta access, or other offers. Eligibility, duration, allowance, and availability may vary and will be disclosed with the offer. Unless the purchase screen clearly says otherwise, a one-time free feature allowance does not automatically enroll you in a paid subscription. RankUp may modify or end a promotion where permitted by law, but will not retroactively change a completed paid transaction.

17. RankUp Pro subscriptions

RankUp Pro is an auto-renewing subscription unless the checkout screen expressly states otherwise. Before purchase, the checkout flow will display the plan, included recurring benefits, billing period, full amount charged, currency, renewal terms, and any trial or introductory terms. By subscribing, you authorize the identified payment provider to charge the payment method on file at the start of each billing period, including applicable taxes, until cancellation.

AI and AGSU allowances apply per subscription period, do not roll over unless the offer expressly says they do, have no cash value, and cannot be transferred. RankUp may use reasonable usage, safety, and rate limits even when an allowance remains. Pro does not change competitive questions, scoring, rating rules, leaderboard treatment, or Readiness capacity.

18. Renewal, cancellation, and refunds

Subscriptions renew for the period disclosed at checkout unless canceled before renewal. Manage or cancel a Stripe-billed subscription through the billing portal linked in Profile settings. If RankUp later offers Apple App Store or Google Play billing, manage that purchase through the applicable store. Deleting the RankUp app or account does not by itself cancel an active subscription unless the purchase provider confirms cancellation.

Cancellation stops future renewal and takes effect at the end of the current paid billing period, so you may continue using paid features through that date. All fees are final and nonrefundable, and RankUp does not provide refunds, prorated refunds, credits for partial periods, or credits for unused allowances, except where a refund is required by applicable law or issued by the payment provider under terms RankUp cannot override. A trial that converts to paid service will disclose its duration, conversion date, renewal price, and cancellation method before enrollment.

19. Price and subscription changes

RankUp may change future prices, included benefits, allowances, or plan structure. Price changes will apply no earlier than the next renewal after any notice and consent required by law or the payment provider. If you do not agree, cancel before the change takes effect. RankUp may immediately change usage controls when reasonably necessary for security, abuse prevention, provider limits, or legal compliance, while handling paid access as required by law.

20. RankUp intellectual property

The Services—including software, interface, brand, Ascending R artwork, original text and questions, explanations, rubrics, data organization, deterministic rules, reports, graphics, and documentation—are owned by RankUp or its licensors and protected by intellectual-property and other laws. No license to RankUp trademarks, logos, source code, datasets, or commercial use is granted except the limited personal-use license above.

21. Public sources and third-party materials

RankUp may cite or link to public government publications and third-party resources. Those materials, names, marks, and links belong to their respective owners and are subject to separate terms. A citation or link does not imply affiliation, endorsement, continuing availability, or that RankUp controls the resource. Open-source components are licensed under their applicable licenses.

22. Feedback

If you voluntarily provide ideas or suggestions about RankUp, you grant RankUp a perpetual, irrevocable, worldwide, royalty-free right to use and commercialize that feedback without restriction or compensation. This does not transfer ownership of unrelated User Content or personal information, which remains governed by the Privacy Policy.

23. Third-party services

The Services depend on third parties such as Firebase, Stripe, OpenAI, Cloudflare, Sentry, hosting providers, Apple, Google, and publication websites. Your use of a third-party checkout, app store, authentication method, linked publication, or device service may be subject to that provider's terms. RankUp is not responsible for third-party services, outages, content, security, or policy changes, but this sentence does not limit rights that cannot be waived by law.

24. Service availability and changes

RankUp may add, modify, suspend, limit, or discontinue features; retire content; correct source versions; change supported devices; or perform maintenance. RankUp does not promise uninterrupted or error-free availability, permanent storage of every result, or continued support for a particular feature. When reasonably practical, RankUp will provide notice of a material change that adversely affects paid access and will honor applicable legal obligations.

25. Suspension and termination

You may stop using RankUp at any time and may request account deletion through the app. Subscription cancellation is a separate step described above.

RankUp may warn, restrict, suspend, or terminate access if it reasonably believes you violated these Terms or the Community Guidelines; created risk or legal exposure; engaged in fraud, cheating, abuse, or a security attack; failed to pay; or if access must be restricted by law or a provider. RankUp will provide notice and an opportunity to appeal when appropriate and legally required, but may act immediately to prevent harm.

On termination, your license ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, limitations, indemnification, dispute terms, and general provisions—will survive. Personal information is handled under the Privacy Policy and account-deletion process.

26. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT, AI OUTPUT, REPORTS, SOURCES, COMPETITIVE FEATURES, AND AGSU FINDINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE." RANKUP DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. RANKUP DOES NOT WARRANT ANY OFFICIAL OUTCOME OR THAT ERRORS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.

27. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANKUP AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, GOODWILL, OPPORTUNITY, OR OFFICIAL OUTCOMES; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO RANKUP FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED OR TO LIABILITY THAT CANNOT LEGALLY BE LIMITED.

28. Indemnification for third-party claims

To the extent permitted by law, you agree to defend, indemnify, and hold harmless RankUp and its owners, officers, employees, contractors, and licensors from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from User Content you had no right to submit, your unlawful or intentional misuse of the Services, or your infringement or violation of another person's rights. This obligation does not apply to the extent a claim results from RankUp's own conduct. RankUp will provide reasonable notice and may control the defense; you may not settle a claim that imposes liability or an admission on RankUp without written consent.

29. Informal dispute resolution

Before filing a lawsuit, you and RankUp agree to try in good faith to resolve the dispute for at least 30 days. Email a written notice describing your name or account handle, the facts, requested relief, and contact information to info@arcticauradesigns.com. RankUp will send notices to the email associated with your account. A notice is received when the receiving party's email system records delivery, provided the sender does not receive a delivery-failure message. This process does not prevent either party from seeking emergency injunctive relief or using a small-claims process where eligible, and any legally required filing deadline is tolled only if applicable law permits.

30. Governing law and venue

These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-law rules, except that applicable federal law and non-waivable consumer protections continue to apply. Any court proceeding must be brought in a state court located in Alaska or the United States District Court for the District of Alaska, and each party consents to personal jurisdiction and proper venue in those courts, except where applicable consumer law permits another forum. These Terms do not require arbitration and do not waive either party's right to participate in a class or representative action where permitted by law.

31. App-store terms

If you download RankUp from Apple or Google, the applicable store's usage rules also apply. These Terms are between you and RankUp, not the store, and RankUp—not the store—is responsible for the Services, support, maintenance, and claims to the extent required by the store terms. The store and its affiliates may be third-party beneficiaries of the mobile-app license and may enforce the provisions that benefit them. Nothing in these Terms limits rights provided by the store or applicable law.

32. Export controls and sanctions

You may not use, export, re-export, or transfer the Services in violation of United States export-control or sanctions laws. You represent that you are not prohibited from receiving the Services under applicable law. This section does not authorize submission of export-controlled, classified, or controlled technical information to RankUp.

33. Electronic communications

You consent to receive agreements, disclosures, receipts, security notices, service notices, and other communications electronically through the Services or the email associated with your account. You may withdraw consent where permitted by law, but doing so may require closing the account if electronic delivery is necessary. Marketing messages require separate consent where applicable and can be disabled without turning off essential service communications.

34. Changes to these Terms

RankUp may update these Terms for changes in the Services, law, providers, security, or business practices. The revised Terms will show an updated date. RankUp will provide notice of material changes and request renewed acceptance when required. Changes apply prospectively from the stated effective date. If you do not agree, stop using the Services and cancel any subscription before the changes take effect.

35. General terms

These Terms, the Privacy Policy, Community Guidelines, and purchase-specific disclosures are the entire agreement regarding the Services unless RankUp agrees otherwise in writing. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective. RankUp's failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; RankUp may assign them as part of a merger, financing, reorganization, or sale, subject to applicable law. Headings are for convenience. The words "including" and "such as" mean without limitation. No agency, partnership, employment, fiduciary, or joint venture is created.

Do not include passwords, authentication tokens, full payment-card data, Social Security numbers, DoD IDs, classified information, controlled operational information, medical records, or personnel records unless a legally authorized secure channel is provided.
